Civil rights attorney Ben Crump announced that a preliminary autopsy commissioned by Kohen’s family suggests the child was struck by gunfire from the side of the vehicle rather than from the front. That detail matters enormously because it appears to challenge the account previously shared by law enforcement, which stated that the vehicle was moving toward officers when shots were fired. If the trajectory is confirmed, it could become central to determining whether deadly force was justified during the encounter.

Standing before supporters at Senatobia Church of Christ, Crump spoke with visible urgency as family members held signs demanding justice for Kohen. The emotional gathering reflected a community still struggling to process how a routine shoplifting response escalated into a deadly encounter involving a baby. Crump emphasized that the family is not asking for speculation or assumptions. Instead, they are demanding transparency, accountability, and access to the evidence that could clarify what truly happened in those chaotic moments.

At the heart of the dispute is the testimony of Kohen’s mother, Vellesiya Wiley, whose account sharply differs from investigators’ version. She says she was seated in the front passenger seat holding her son when officers approached with weapons drawn. According to her, the driver was attempting to leave the area rather than drive directly at police. She maintains that she raised Kohen in plain view, hoping officers would recognize a child was inside the vehicle before any shots were fired. Moments later, gunfire erupted.

The family argues that only video evidence can resolve the growing conflict between official statements and eyewitness accounts. Crump has called for the release of body camera recordings, dash camera footage, and surveillance video from the nearby Walmart location where the confrontation began. Those recordings, the family says, may reveal the vehicle’s exact movement, officer positioning, and whether there was an immediate threat that warranted the use of lethal force. The shooting occurred after officers responded to a reported shoplifting call at the Senatobia Walmart on June 14. Investigators said officers attempted to stop a vehicle connected to the incident and that the driver nearly struck law enforcement personnel. An officer identified as Hunter Foster fired his weapon before the vehicle left the scene. The car later arrived at a hospital, where Kohen was pronounced dead. Another occupant, identified by relatives as Kohen’s aunt, suffered critical injuries and required emergency treatment.

Public anger has continued to grow since the shooting, fueled by grief and deep concern over policing standards involving children and bystanders. Demonstrations outside the Senatobia Walmart drew large crowds, with many residents demanding independent oversight and a complete release of evidence.
